摘 要:作为一种新兴的交通服务模式,网约车在带来便捷出行、增加就业机会、促进产业创新等多方面积极影响的同时,也引发了一系列监管挑战。网约车监管中的价值冲突主要表现在安全与效率的价值冲突、政府监管与市场自主的价值冲突、创新与规制的价值冲突、公平竞争与市场垄断的博弈等方面。充分借鉴国外监管经验与深刻反思国内监管实践,厘清多元利益相关者的角色,选择适合国情的多方主体参与的多元监管模式,促进技术创新与监管的融合,完善网约车监管制度,协调各方利益,平衡各种价值冲突,希望通过本研究为网约车行业制定更为科学合理的法律政策提供参考。As an emerging mode of transportation service,online car hailing has not only brought about convenient travel,increased employment opportunities,promoted industrial innovation and other positive impacts,but also triggered a series of regulatory challenges.The value conflict in the supervision of online car sharing is mainly manifested in the value conflict between safety and efficiency,the value conflict between government supervision and market autonomy,the value conflict between innovation and regulation,and the game between fair competition and market monopoly.Fully learn from foreign regulatory experience and deeply reflect on domestic regulatory practices,clarify the role of multiple stakeholders,choose a multisubject participation of multiple regulatory models suitable for national conditions,promote the integration of technological innovation and supervision,improve the regulatory system of online car sharing,coordinate the interests of all parties,and balance various value conflicts.So as to provide a reference for the network car industry to develop more scientific and reasonable legal policies.
