诉源治理视域下民事纠纷解决方法研究

摘　　要：完善民事纠纷解决机制是能消除基层矛盾,减轻法院负担的方法。了解诉源治理用于解决民事纠纷的必要性,肯定诉源治理的应用价值。建立民事纠纷解决与诉源治理融合的方法,提出强调诉源治理制度层次性、多元主体协同共建、构建与运行智能化民事纠纷解决系统、集成多元化解纷方法。强化诉源治理在化解纠纷、解决矛盾中的应用效果。In order to further improve the mechanism for resolving civil disputes,this article analyzes ways to eliminate the contradictions at the grass-roots level and to lighten the burden of the court the resolution of civil disputes as the following:understanding the necessity of using litigation source governance to resolve civil disputes,and affi rming the application value of litigation source governance;introducing the practical methods of integrating civil dispute resolution and litigation source governance.To this end,four suggestions are proposed:emphasizing the hierarchical nature of litigation source governance system,taking collaborative construction of multiple subjects,constructing and operating intelligent civil dispute resolution system,and integrating diversifi ed dispute resolution methods.By recognizing the application eff ect of litigation source governance in resolving disputes and confl icts,we hope to provide reference for future civil dispute resolution.
