论体育赛事传播的保护路径——以体育赛事转播权的构造为中心

摘　　要：体育赛事并非著作权法意义上的作品,因此体育赛事组织者不能直接通过著作权法的规定实现对体育赛事传播的控制。在立法上,可创设体育赛事转播权,赋予体育赛事组织者专有权利以控制体育赛事的传播。该项权利是以体育赛事为客体,以控制体育赛事传播为内容的一项新型财产权利。体育赛事转播权与体育赛事直播画面著作权在客体、性质、内容等方面存在显著差异。体育赛事直播画面的播放必然伴随着体育赛事的传播,但根据权利用尽原则,体育赛事直播画面的传播者只需取得体育赛事直播画面著作权人的许可。体育赛事转播权作为一项排他性权利,并不意味着体育赛事组织者享有对体育赛事传播的绝对控制,其权利行使应当受到合理利用原则的限制。Sports events are not works under provisions of the copyright law,so organizers of sports events cannot directly control the dissemination of these events in accordance with the copyright law.It is suggested that legislative bodies establish a right to broadcast sports events,thereby endowing sports event organizers with an exclusive right to control the dissemination of these events.This should be a new type of property right,with a sports event as the legal object and the control over the dissemination of the sports event as its content.The right to broadcast sports events is markedly distinct from the copyright of live sports event footage in terms of their objects,nature,and content.The broadcast of live sports event footage necessarily involves the dissemination of sports events,but according to the principle of exhaustion of rights,the disseminator of live sports event footage is merely required to secure permission from the copyright proprietor of such live footage.The right to broadcast sports events,as an exclusive right,does not confer upon the event organizer absolute control over the dissemination.The exercise of this right should be restricted under the principle of reasonable use.
