摘  要:当前,作为一种社会治理模式的“枫桥经验”,在顶层设计层面和基层社会层面都和人民调解制度关联了起来,但“枫桥经验”和人民调解二者各自的独立运作逻辑和双方的互动边界并未得到很好的澄清。系统梳理“枫桥经验”和人民调解的本质属性,在此基础上对实践层面二者关系交汇进行现实描述,并对“枫桥经验”切入人民调解进行应然理论构建,从而形成用以判定实践中人民调解对于“枫桥经验”借鉴的基本判准,对于理解二者关系具有重要意义。只有充分尊重二者逻辑和功能界限,才能切实保障“枫桥经验”成为人民调解创新发展的良性动力,最终通过助力人民调解化解基础社会矛盾,提升我国社会的基层治理水平。The“Fengqiao Experience”has been established as a model of social governance,with links to the people’s mediation system at both the top design level and the grass roots social level.However,the logic of the independent operation of the“Fengqiao Experience”and people’s mediation,as well as the boundaries of their interaction have yet to be fully elucidated.The systematic sorting out of the essential attributes of the“Fengqiao Experience”and people’s mediation,the description of the realities of the intersection of the relationship between the two at the practical level,and the construction of contingent theory of the“Fengqiao Experience”into people’s mediation all contribute to the development of a basic criterion for judging people’s mediation in practice.This criterion is of great significance to the understanding of the relationship between the two.It is only by fully respecting the logic and functional boundaries of the two can we ensure that the“Fengqiao Experience”becomes a benign impetus for the innovative development of people’s mediation.Ultimately by helping people’s mediation to resolve basic social contradictions,we can raise the level of grassroots governance in our society.
