虚假短视频摆拍的治理困境与法治因应--基于规范文本与实践案例的实证考察

摘　　要：“流量为王”的时代下,虚假短视频摆拍的乱象已然对社会秩序造成严重的负面影响,如何引导与促进短视频行业的有序发展实为净化社会风气的重要内容。以虚假短视频摆拍的规范文本与实践案例的实证考察为视角,将虚假短视频摆拍存在的法律规范缺失、监管效果欠佳、惩罚力度不足、救济路径纰漏的治理困境予以廓清。“包容审慎监管理念”下“让子弹再飞一会儿”的立法策略导引可以作为解释虚假短视频摆拍治理困境形成的一种逻辑存在。由此在宏观层面以多元主体协同共治与行为内生激励为理念思路,在微观层面以法律规范的健全、监管效能的提升、惩罚力度的强化、救济路径的完善为实施路径,形塑横向与纵向一体化的法治因应格局。In the era where Internet traffic is the key indicator to a product or a platform,the chaos of fake short video posing has brought serious negative impact on the social order,and how to promote the orderly development of short video industry is a question worth pondering.This paper combines the examination of the normative text with the review of practice cases of false short video posing,and tries to clarify the governance dilemma of false short video posing.Thus,it proves that there exists a lack of specialized legal norms,poor regulatory effect,insufficient punishment,and faulty relief paths in the legal regulation of fake short video auctions.It proposes to shape the concept of collaborative and common governance of multiple subjects and the construction of endogenous incentives for behaviors from the macro perspective,design the legislative framework of the legal system of fake short video auctions dominated by departmental regulations from the intermediate perspective,and make the legislative framework of the legal system of fake short video auctions dominated by departmental regulations from the micro perspective.Video Pendulum Shooting legal regulation of the existing deficiencies in one by one responsed by the law,in order to promote the healthy development of the short video industry on the track of the rule of law.
