检察大数据法律监督的法理逻辑与视域诊定

摘　　要：在展开大数据法律监督时,应严格遵循法律监督的基本原理和方法。回顾检察信息化的发展历程,大数据法律监督代表着检察信息化发展进入数字时代后,检察法律监督的结构性转变。值得注意的是,大数据法律监督是对检察监督方法的创新,而非对检察法律监督权力的增强。从运行方式来看,大数据法律监督应重点关注证据审查,审慎运用侦查思维,并以典型个案监督为突破口,推动类案监督的落地,从而实现检察办案与诉源治理、溯源治理的有机结合。从法律监督的定位出发,大数据法律监督应坚守客观公正的立场,积极履行职责,并拓展至四大检察领域。同时,大数据法律监督必须注意其边界限制,强化数字时代公民隐私权的保护,并确保方法运用的程序正当性。In the process of implementing big data legal supervision,it is essential to strictly adhere to the basic principles and methods of legal supervision.Looking back at the development history of prosecutorial informatization,big data legal supervi-sion represents a structural transformation in prosecutorial legal supervision as prosecutorial informatization enters the digital age.It is worth noting that big data legal supervision is an innovation in the methods of prosecutorial supervision,rather than an en-hancement of prosecutorial legal supervision powers.From the perspective of operational methods,big data legal supervision should focus on evidence review,use investigative thinking prudently,and use typical case supervision as a breakthrough to pro-mote the implementation of similar case supervision,thus achieving an organic integration of prosecutorial case handling with liti-gation source governance and traceability governance.Starting from the positioning of legal supervision,big data legal supervi-sion should adhere to an objective and impartial stance,actively fulfill its duties,and extend into the four major areas of prosecu-tion.Meanwhile,big data legal supervision must pay attention to its boundary limitations,strengthen the protection of citizens’privacy rights in the digital age,and ensure the procedural legitimacy of the methods used.
