摘　　要：党的司法政策是党的政策在司法领域的重要呈现,对现当代中国的革命、建设和发展起到了举足轻重的作用。党的司法政策经历了从“事实上的法”“行动中的法”到形塑“回应型的法”、塑造“引领型的法”的历史变迁过程;其变迁受到社会主要矛盾、时代主题任务、治国理政理念以及党的指导思想创新等逻辑因素的深刻影响。追寻党的司法政策的发展历程,可以总结和凝练党的司法政策成功的基本经验:始终坚持党作为最高政治领导力量的权威追求,充分展现治国理政的法治追求,贯彻实现理想社会秩序的价值追求,以及维护以人民为中心的实践追求。理论和实践层面的总结与分析表明,党通过司法政策治理国家和社会,是党带领中国人民不断推进国家治理体系和治理能力现代化的重要方式,深刻展现党的司法政策塑造中国特色社会主义法治的历史过程,不断丰富中国式法治现代化的内涵。The judicial policy of the the Communist Party of China(CPC)is an important manifestation of the Party's policy in the field of justice,and has played a pivotal role in the revolution,construction,and development of contemporary China.The judicial policy of the Party has undergone a historical transformation from"de facto law"and"law in action"to shaping"responsive law"and"leading law".The transformation is deeply influenced by logical factors such as the main contradictions in society,the theme and tasks of the times,the concept of governing the country,and the innovation of the Party's guiding ideology.Tracing the development of the CPC's judicial policy,the basic experience of the success of the Party's judicial policies can be summarized and condensed as follows:always adhere to the authoritative pursuit of the Party as the highest political leadership force,fully demonstrate the pursuit of the rule of law in governing the country,implement the value pursuit of realizing the ideal social order,and uphold the practical pursuit of putting the people at the center.The summary and analysis at the theoretical and practical levels show that the Party's governance of the country and society through judicial policies is an important way for the Party to lead the Chinese people to continuously promote the modernization of the national governance system and governance capacity,profoundly demonstrate the historical process of the Party's judicial policies shaping the socialist rule of law with Chinese characteristics,and constantly enrich the connotation of the modernization of the Chinese rule of law.
