论社会组织环境民事公益诉讼监督机制的构建

摘　　要：目前我国由社会组织提起的环境民事公益诉讼呈现出两极分化的现象:一些全国性的大型环保组织提起了一批在全国范围内有较大影响力的环境民事公益诉讼案,有力推动了环境民事公益诉讼制度的发展;同时,我国也有部分小型环保组织在利用环境民事公益诉讼牟利。我国的社会组织环境民事公益诉讼制度存在缺少针对社会组织诉讼行为的监督机制、社会组织是否利用公益诉讼牟利的判断标准不明确、社会组织利用公益诉讼牟利的法律后果不明确等问题。对此,应当通过构建以检察监督为核心的监督体系、确立检察机关的强制支持起诉制度、明确社会组织是否利用公益诉讼牟利的判断标准、完善对非法牟利社会组织的处罚规则等途径予以应对。At present,the environmental civil public interest litigation filed by social organizations in China presents a polarizing phenomenon:some large national environmental protection organizations have filed a number of environmental civil public interest litigation cases with great nationwide influence,which has effectively promoted the development of environmental civil public interest litigation system.Meanwhile,some small-scale environmental protection organizations in China are also using environmental civil public interest litigation for profit.China s system of environmental civil public interest litigation by social organizations has some problems,such as lack of supervision mechanism for social organizations litigation behavior,unclear judgment criteria for whether social organizations use public interest litigation for profit,and unclear legal consequences for social organizations using public interest litigation for profit.In response to these issues,it is necessary to construct a supervision system with procuratorial supervision at its core,establish a mandatory support for prosecution system of procuratorial organs,clarify the criteria for determining whether social organizations are using public interest litigation for profit,and improve the penalty rules for social organizations engaging in illegal profit-making activities.
