摘 要:建设工程承包合同中的固定总价是相对固定的,是在一定风险范围内的价格固定、价款不可调,而风险范围外仍需调整。结合大量司法案例来看,固定总价合同管理过程中易出现工程清单缺陷导致的争议、建材价格大幅上涨引发的争议、未完工时结算产生的争议等。本文在对常见固定总价争议分析的基础上,分别在合同策划、签订、履行阶段,相应提出发包人慎重选用总价合同、承包人审慎参与总价投标,发承包双方完善总价合同条款、合理分担风险,并对出现的争议尽量友好协商解决等管理建议。Thefixed lump sum in the construction project contract is relativelyfixed,and the contract sum isfixed and the price not adjustable within a certain risk range,but it still needs to be adjusted outside the risk range.Combined with a large number of judicial cases,disputes caused by the bill of quantities defects,the sharp rise in the price of building materials,and the settlement when not completed are prone to occur in the process of thefixed lump sum contract management.Based on the analysis of the common disputes,this paper puts forward some management suggestions in the stages of contract planning,signing and performance respectively.For example,the employer carefully selects the fixed lump sum contract,the contractor cautiously participates infixed lump sum bidding,both parties of contract improve the terms of thefixed lump sum contract,share risks reasonably,and resolve the disputes as friendly as possible through negotiation.
