摘　　要：海南自贸港作为知识产权证券化先行试点地区,面临的法律风险主要源于法律法规不完善、专业人才稀缺及配套机制不健全。在知识产权证券化过程中,美国中介服务机构发挥了重要作用,欧洲建立了社会信用增级机制,日本政府高度参与激发了市场活力。借鉴其经验,结合国情及自贸港特点,可从完善法律制度、培养专业人才、健全配套机制等方面防范法律风险。As a pilot area for intellectual property securitization in advance,Hainan Free Trade Port faces legal risks mainly due to imperfect laws and regulations,scarcity of professional talents and imperfect supporting mechanisms.In the process of intellectual property securitization,American intermediary service institutions have played an important role.Europe has established a social credit enhancement mechanism.The high participation of the Japanese government has stimulated market vitality.Drawing on their experience and combining national conditions and the characteristics of the free trade port,legal risks can be prevented from aspects such as improving the legal system,cultivating professional talents,and improving supporting mechanisms.
