从魏晋志怪小说中的公案故事看中国法律文化

摘　　要：始自宋代的公案小说是我国古典小说中一类重要的题材。然而追根溯源,早在中国小说萌芽阶段的魏晋时期,志怪小说中就已出现具有“公案”因素的诸多故事情节。志怪小说中的公案故事实际上是现实社会的政治法律问题的文学再现,既体现了当时社会法律制度、法律思想的发展演变,也反映了当时人们的法律观念、法律心理,对特定时期中国传统法律文化的研究具有独特的价值。Public case novels,originating from the Song Dynasty,are an important genre of classical Chinese novels.However,tracing back to the origin,as early as the embryonic stage of Chinese novels in the Wei and Jin Dynasties,many storylines with“public case”elements had already appeared in novels of mystery and the supernatural.The public case stories in those novels are actually literary reproductions of political and legal issues in real society.They not only reflect the development and evolution of the social legal system and legal ideology at that time,but also reflect people's legal concepts and psychology at that time.They have unique value in the study of traditional Chinese legal culture in a specific period.
