一起涉嫌未取得动物诊疗许可证从事诊疗活动投诉案的分析

摘　　要：2022年11月,A市B区农业农村委员会接到投诉举报,称辖区内某宠物美容院涉嫌未取得动物诊疗许可证从事动物诊疗活动。经立案调查,认定当事人违法事实存在,根据《中华人民共和国动物防疫法》相关规定,依法给予了行政处罚。本文对该起案件进行了分析,指出案件办理中存在的证据不完整、法律适用不准确等问题,并以此为例,从加大宠物服务机构管理力度,提高执法人员办案水平,加强法律法规宣传与培训等方面提出了思考建议,以期为广大执法工作者宠物诊疗监管实践提供参考。In November 2022,a complaint was received by the Agricultural and Rural Committee in B District,A City,claiming that a pet salon under its authority was suspected of engaging in animal medical activities without an animal clinic license.Upon investigation,the party concerned was determined to have illegal facts,and administratively punished according to relevant provisions of the Law of the People's Republic of China on Animal Disease Prevention.In the paper,the case was analyzed to identify some shortcomings such as incomplete evidence,inaccurate application of laws,etc.,and recommendations were put forward based on the case,that was,further supervising pet services,improving the skills of law enforcement officers,strengthening the publicity about laws and regulations as well as training,with a view to guiding law enforcement officers in their supervision practices for pet medical services.
