摘　　要：民营经济的高质量发展需要立法促进。通过统合性、高位阶的立法将现有促进民营经济发展的政策和地方性立法予以统筹,为民营经济发展提供坚实法治保障的系统性解决方案。民营经济促进法的制定,应当贯彻党的二十大和二十届三中全会精神,立足民营经济高质量发展的迫切需求,重点面向合法权益保护、公平发展、扶持激励、规范经营等立法理念。在理解适用中,应正视多元主体利益诉求所衍生的调整对象平衡、立法价值确立、立法路径选择等立法难点,并依据立法理念进行协调。在制度转化中,民营经济促进法应围绕立法理念提炼、构建基本原则和核心规则,进而形成系统的规范体系,推动实现民营经济高质量发展。The high-quality private sector development needs the help of legislation.Existing policies and local laws promoting the development of the private sector should be coordinated through comprehensive and high-level legislation,so as to provide a systematic solution for the growth of the private sector with a sound and solid guarantee of the rule of law.The formulation of the Private Sector Promotion Law should adhere to the spirit of the 20th National Congress of the Communist Party of China(hereinafter referred to as the"CPC")and the Third Plenary Session of the 20th CPC Central Committee,focus on the urgent needs for high-quality development of the private sector,and take the protection of legitimate rights and interests,equitable development,support and incentives,and the regulation of operations as the core legislative ideas.In the understanding and application of this law,the balance of the adjustment object,the recognition of the legislative value,the selection of legislative paths and other legislative challenges arising from the various interests of diverse stakeholders should be faced squarely and coordinated on the basis of the legislative ideas.In terms of institutional transformation,the Private Sector Promotion Law should refine and establish basic principles and core rules around its legislative ideas,so as to contribute to a systematic regulatory framework for promoting the high-quality development of the private sector.
