论居委会协助行政职能的制度重塑

摘　　要：居委会“协助行政负担过重”是当前基层群众性自治组织充分实现其法定功能的主要障碍,法律规范无法因应实践中行政职能的扩张。协助行政职能制度供给不足和理论研究的缺乏,使得居委会协助行政职能无法在法律层面得到有效解决。居委会协助行政职能可分为法定协助行政职能和约定协助行政职能,前者是居委会根据法律规定履行协助行政义务,后者则是居委会与基层政府充分协商,通过行政协议等方式履行法定义务之外的协助行政义务。重塑居委会协助行政职能,应确立自治优先、效率导向、目标平衡、遵从法定、适度开放原则,完善居委会协助职能的资源配置,实行协助行政事项公开并定期组织评估,明确事项范围及生成规范、行为定性与责任归属,同时实施必要的程序规范,保障居委会协助行政职能的有效运行。The overwhelming administrative burden placed on residents committees is a primary obstacle to grassroots organizational autonomy,while the existing legal norms fail to address the expansion of administrative functions in practice.The insufficient provision of institutional frameworks and a lack of theoretical research have hindered effective legal solutions for the assisting role of residents committees.These assisting functions can be either statutory assisting functions or agreed assisting functions.The former involves residents committees fulfilling their obligations as mandated by law,while the latter pertains to engaging in extensive consultations with grassroots governments to perform assisting obligations beyond those legally required,typically through administrative agreements.To reconstruct the assisting administrative functions,it is essential to establish the principle of prioritizing autonomy,efficiency,balanced goals,legal prescription,and appropriate openness.To this end,it involves improving the resource allocation,ensuring transparency,and regular evaluations.Additionally,it is crucial to clearly define the scope of tasks,establish generating norms,specify actions,and assign responsibilities.Implementing necessary procedural norms will help ensure the effective operation of residents committees'assisting administrative functions.
