摘　　要：本研究探讨了种子产业合法化进程中的法律与政策挑战,重点分析了知识产权保护、生物多样性保护、市场准入与监管以及农民权利保护等关键问题。以美国转基因种子合法化的法律政策演变、欧盟对种子法的改革和中国种子法的修订与实施情况为案例,详细阐述了各国在种子法制建设中的具体实践与成效。研究表明,种子产业的发展离不开科学合理的法律与政策框架,完善的知识产权保护制度、优化的市场准入与监管机制、技术的创新、国际之间的合作以及农民权益的保护是应对种子产业法律与政策挑战的关键。本研究期望为种子产业的法律与政策制定提供理论依据和实践参考。This study explores the legal and policy challenges in the legalization process of the seed industry,focusing on key issues such as intellectual property protection,biodiversity conservation,market access and regulation,and farmers'rights protection.Using case studies of the legal and policy evolution of GMO seed legalization in the United States,the reforms of seed laws in the European Union,and the revision and implementation of seed laws in China,the study elaborates on the specific practices and outcomes of different countries in seed law construction.The study indicates that the development of the seed industry relies on a scientific and rational legal and policy framework.Key measures to address the legal and policy challenges in the seed industry include a well-established intellectual property protection system,optimized market access and regulatory mechanisms,technological innovation,international cooperation,and the protection of farmers'rights.This study aims to provide theoretical foundations and practical references for the formulation of laws and policies in the seed industry.
