摘 要:本研究探讨了公私合作模式(public-private partnership,PPP)在种子产业中的应用及其所面临的法律挑战。本研究分析了公私合作模式的核心特征和跨行业成功应用的例证,具体阐述了其在种子产业中的实际效果,特别是如何加速技术创新并实现风险共担。在法律挑战方面,本研究详细讨论了知识产权保护、合同违约与诈骗行为以及跨国合作中的法律适用问题,揭示了现行法律框架中存在的不足;并且提出了针对现有政策和实践中存在问题的具体改进建议,强调了构建合理有效的合作机制的重要性。本研究表明通过深化公私合作,种子产业可朝着更为高效且创新驱动的方向发展,促进全球农业的可持续进步。This study explores the application of public-private partnership(PPP)models in the seed industry and the legal challenges they encounter.The research analyzes the core features of PPP models and examples of their successful application across various industries,specifically elaborating on their practical effects within the seed industry,notably in accelerating technological innovation and sharing risks.In terms of legal challenges,the study thoroughly examines issues related to intellectual property protection,contract breaches,and fraud,as well as the application of laws in cross-border cooperations,highlighting deficiencies in the current legal frameworks.Additionally,it offers concrete suggestions for improving existing policies and practices,emphasizing the importance of establishing a reasonable and effective cooperative mechanism.The study indicates that by deepening public-private collaboration,the seed industry can evolve towards a more efficient and innovation-driven direction,thereby promoting sustainable progress in global agriculture.
