摘　　要：贸易自由化一直是国际贸易谈判中的核心话题,非歧视待遇规则是推进贸易自由化实现的法律基础。在数字贸易迅速发展的背景下,传统的非歧视待遇规则不可避免地在适用对象、适用范围等方面存在滞后性。随着数字贸易规则协商制定的区域化转向,不同时期的贸易协定开始通过规则类比和多边谈判两种路径对数字产品非歧视待遇规则进行塑造。然而没有统一的国际规则就意味着数字贸易规则领域的博弈和竞争会日益激烈,最终导致全球经济利益分配的不均和贸易政策保护主义的加剧。推动数字产品非歧视待遇规则的国际构建,需要我国积极参与数字治理,从国内法层面明确数字产品的服务属性、调整市场准入规则、加强数字产品知识产权保护,在对接高标准国际数字规制的同时,结合全球数字经济发展态势推动相关制度的发展。Trade liberalization has been a core topic in international trade negotiations, and the rules of non-discriminatory treatment are the legal basis for advancing the realization of trade liberalization. With the rapid development of digital trade, the traditional rule of non-discriminatory treatment inevitably has a lag in terms of the target and scope of application.With the regionalization shift in negotiated rule-making for digital trade, trade agreements of different periods began to shape the rules on non-discriminatory treatment of digital products through two paths: rule analogy and multilateral negotiation.However, the absence of harmonized international rules means that the game and competition in the field of digital trade rules will become increasingly intense. This ultimately leads to an uneven distribution of global economic benefits and increased protectionism in trade policy. Promoting the international construction of rules on the non-discriminatory treatment of digital products requires China's active participation in digital governance. It is necessary to clarify the service attributes of digital products at the level of domestic law, adjust market access rules, strengthen the protection of intellectual property rights for digital products, and push for the development of the relevant systems in the light of the development of the global digital economy while connecting with high-standard international digital regulations.
