刑事一体化理念下轻罪治理模式的反思与重构

摘　　要：要完善公共安全治理机制,健全社会治理体系,轻罪治理模式的完善是其中不可或缺的重要环节。虽然当前轻罪治理的立法扩大化维护了社会稳定,催生了刑事诉讼制度变革,但是也暴露了立法数量与案件数量同步增长的新问题。分析治理效果偏离立法初衷、诉讼程序“直筒化”及轻重犯罪处遇同质化的现实困境,可以发现理念上“重司法出罪轻立法出罪”的内生悖论、立法时忽视二元违法行为制裁体系、实践中“零容忍”治安执法策略及绩效考核压力是其内在成因。有必要反思当前的轻罪治理模式,重塑“刑事一体化”的协同治理理念、形成“立法克制入刑”与“司法分流处理”的功能互补,方能实现轻罪治理在中国特色社会主义法治体系建设中的重要功能。To improve the public security governance mechanism and the social governance system, the improvement of misdemeanor governance model is an indispensable and important part. Although the current legislative expansion of misdemeanor governance has maintained social stability and spawned changes in the criminal procedure system, the new problem of synchronous growth of the number of statutes and the number of cases has also been exposed in the governance process. Based on the real dilemma of the governance effect deviating from the original legislative intent, the straightening of the litigation procedure and the homogenization of the treatment of misdemeanor and crime, we can find the endogenous paradox of the concept of “focusing on the judicial crime but not the legislative crime”, the neglect of the binary system of sanctions for illegal behavior in the legislation, and the “zero tolerance” law enforcement strategy and performance appraisal pressure are its intrinsic causes. It is necessary to reflect the current misdemeanor governance model, reshape the collaborative governance concept of “criminal integration”, form complementary functions between “legislative criminalization” and “judicial diversion”, in order to realize the important function of misdemeanor governance in the construction of socialist legal system with Chinese characteristics.
