依据、隐患与对策:职业体育领域中“道德条款”的应用研析

摘　　要：近年来,受文娱产业的带动,“道德条款”被引入到职业体育领域,成为预防与惩罚职业运动员言行道德失范的重要手段。该条款所拥有的行为规训、责任切割、损害补救等多种机能,使其不仅在体育商业代言、赞助中得到应用,也在体育劳动合同、人才培养及其行业管理方面得到了推广。然而,该条款在职业体育领域中的应用时间较短,并且尚未与体育深度融合,以致出现了边界模糊、过度扩张、与隐私保护冲突等隐患。为了排除这些应用隐患、发挥其应有机能,应当在厘清道德失范行为边界的基础上,划定合理的适用范围,兼顾职业运动员个人隐私保护与权利保障,为体育事业的健康发展保驾护航。In recent years,driven by the cultural and entertainment industry,“moral clauses”have been introduced into the field of professional sports,becoming an important means of preventing and punishing professional athletes' moral misconduct.The multiple functions of the clauses,such as behavioral discipline,liability cutting and damage remediation,have enabled them not only to be applied in sports business endorsements and sponsorship,but also to be promoted in sports labor contracts,talent cultivation and industry management.However,the application time of the clauses in the field of professional sports is relatively short after all,and it has not yet been deeply integrated with the particularity of sports,resulting in hidden dangers such as blurred boundaries excessive expansion and conflicts with privacy protection.In order to eliminate these potential applications danaers and bring their potential into play,it is necessary to clarify the boundaries of moral misconduct,delimit a reasonable scope of application take into account the protection of personal privacy and rights of professional athletes',so as to and safeguard the healthy development of sports.
