摘　　要：最高人民法院《九民会议纪要》(2019)及我国《民法典》对法定抵销权均有所规定,但司法实务中抵销权应用规则仍存在模糊不清的情形。基层法院法官对当事人在诉讼或执行程序中提出的抵销主张,往往简单拒绝。加强对抵销规则的深入研究,有助于正确行使抵销权,确保债权效力,实现法律目的。笔者从抵销权行使条件、抵销是否具有溯及力,抵销权的优先性等具体情形出发对抵销权制度进行分析研究,期望对完善我国抵销规则有所裨益。The minutes of the Ninth People’s Congress of the Supreme People’s Court(2019)and the Civil Code of China both provide for the statutory right of offset.However,there are still unclear rules for the applica⁃tion of offset in judicial practice.Grassroots court judges often simply refuse offsetting claims made by parties in litigation or enforcement proceedings.Strengthening in-depth research on the rules of offset can help to correct⁃ly exercise the right of offset,ensure the effectiveness of creditor’s rights,and achieve legal objectives.The au⁃thor analyzes and studies the system of offsetting rights from specific situations such as the conditions for exercis⁃ing offsetting rights,whether offsetting has retroactive effect,and the priority of offset rights,hoping to contrib⁃ute to the improvement ofChina’s offset rules.
