摘　　要：网络著作权犯罪是网络知识产权犯罪的主要犯罪类型,其定性争议频发,立法规定和司法适用均颇受质疑。《刑法修正案(十一)》的颁布,在立法层面回应了网络著作权犯罪的定性问题,然而,修法是否契合司法实践,如何规范网络著作权犯罪的认定需要进一步回答。以《刑法修正案(十一)》颁布之前的2024个网络著作权犯罪样本为分析对象,运用定量研究方法发现网络著作权犯罪的定罪机制。通过分析发现:控辩因素对定罪具有潜在影响、刑罚与定罪存在一定的逆向制约关系、主观目的是司法实务考量的首要因素。在立法积极修正的背景下,司法应当对既有的司法裁判规则进行完善,通过辩护因素与指控因素的衡平、裁判说理对定罪逻辑的阐释和司法解释对相关概念的明确,以准确适用罪名,实现司法裁判的统一。Online copyright infringement is the main crime type of Internet intellectual property crime,but its qualitative disputes frequent occur,and the legislative provisions and judicial application are questioned.The promulgation of the"Amendment(Ⅺ)to the Criminal Law"has responded to the qualitative question of online copyright infringement at the legislative level.However,whether the amendments conform to judicial practice and how to regulate the identification of online copyright infringement need further answers.This paper takes 2024 samples before the promulgation of"Amendment(Ⅺ)to the Criminal Law"as the analysis object,and uses quantitative research methods to discover the criminalization mechanism of online copyright infringement.Through analysis,it is found that:the factors of prosecution and defense have potential influence on conviction,there is a certain reverse constraint relationship between punishment and conviction,and subjective purpose is the primary factor to consider in judicial practice.In the context of active amendments to legislation,the judiciary should improve the existing judicial adjudication rules through the balance of defense and accusation factors,the interpretation of the logic of conviction by the reasoning of the judgment,and the clarification of the relevant concepts in the judicial interpretation,so as to accurately apply the charges,and realize the unity of judicial adjudication.
