摘 要:将科研诚信管理纳入法治化轨道,建立健全管理体制和相关机制,是解决学术不端问题、推动社会信用建设的治本之策。近年来,我国中央和地方层面出台了一系列科研诚信政策法规,科研诚信管理制度化、法治化程度不断提高。但从整体来看,我国科研诚信管理仍然面临基本概念存在歧义、政策法规不够统一、责任体系尚不健全、调查处理机制有待完善等问题和短板。需要出台一部国家法律层面或者行政法规层面的专门立法,厘清基本概念、健全责任体系、细化调查规则、建立负责任的科研行为培育机制,形成多主体多层次依法治理科研诚信的新格局。Integrating scientific research integrity management into the legal track,establishing and improving management systems and related mechanisms,is the fundamental solution to address academic misconduct and promote social credit construction.In recent years,China's central and local levels have introduced a series of policies and regulations on scientific research integrity,and the institutionalization and legalization of scientific research integrity management have been continuously improved.However,overall,China's scientific research integrity management still faces problems and shortcomings such as ambiguity in basic concepts,lack of unified policies and regulations,incomplete responsibility system,and incomplete investigation and handling mechanisms.A specialized legislation at the national legal or administrative regulatory level is needed to clarify basic concepts,improve the responsibility system,refine investigation rules,establish a responsible scientific research behavior cultivation mechanism,and form a new pattern of multi-party and multi-level governance of scientific research integrity in accordance with the law.
