协商何以促安全?社区纠纷非诉化解的“分级协商”策略

摘　　要：安全与秩序是现代政府行政的价值寻求,也是公共管理研究的大问题。对社会纠纷的治理效果关系到社会安全的实现程度。既有研究分析了制度建构和技术赋能促成安全秩序的“硬性”维度,但对“协商何以促安全”这一“柔性”路径讨论较少。研究将视角拉长至议事会的构建阶段,详细呈现了议事协商的制度背景、构建过程和运行机理,从整体上探析了为何协商、协商如何构建和协商如何促安全这些关键议题。在资源约束、安全考核剧增的情境下,基层构建出“分级协商”模式,以协商这一柔性机制将部分发生在邻里个体之间、个体与物业之间的细事纠纷化解在社区、小区乃至楼栋,发挥了分流和过滤的治理效果,使得正式系统得以“腾出”资源应对那些法律关系复杂和社会影响严重的纠纷事件。分级协商不仅有助于补充安全秩序达成的柔性视角,从而全面和真实把握当下中国促成社会安全的新路径,还有助于对“完善公共安全治理机制”“统筹发展和安全”等重大命题提供学理参照。Security and order are the value of modern government administration,and it is also a big problem in public management research.The governance effect of social disputes is related to the realization of social security.Existing studies have analyzed the"hard"dimension of system construction and technology enabling to promote security order,but there is less discussion on the"soft"path of"how to promote security through negotiation".The research extends the perspective to the construction stage of the fo⁃rums,presents the institutional background,construction process and operation mechanism of the negotiation in detail,and probes into the key issues such as why negotiation,how to construct negotiation and how to promote security through negotiation as a whole.In the context of resource constraints and increased safety assessment,the grass-roots level builds a"graded negotiation"model,which uses the flexible mechanism of negotiation to resolve the minor disputes between individuals in the neighborhood and be⁃tween individuals and property in the community,residential area and even buildings,and plays the governance effect of diversion and filtration.It allows the formal system to"free up"resources to deal with disputes with complex legal relationships and serious so⁃cial impact."Graded negotiation"not only helps to supplement the soft perspective of security order,but also fully and truly grasp the new path of promoting social security in China at present.It also helps to provide theoretical reference for major propositions such as"improving the public security governance mechanism"and"coordinating development and safety".
