平台互联互通的反垄断法多元机制协同规制路径研究

摘　　要：服务与数据的高质量互联互通是平台经济快速发展的基础。针对多种类型的平台拒绝互联互通行为,国家主要通过反不正当竞争法事后行为规制以及超大型平台主体责任事前设权两条路径进行规制。但由于平台经济竞争的动态性和复杂性,现有路径显然力有不逮,必须补充构建相应的反垄断法路径,引入多元机制协同规制来完整实现平台互联互通。具体而言,反垄断法路径需要在引入和扩展竞争中性原则的背景下,设计平台经济下独立的必需设施原则,以合理缩限平台主体责任的范围和程度,同时构建“平台契约+行业自治”的联合治理机制,以实现平台互联互通的长效运行、契约治理机制设计、完成反垄断法路径与反不正当竞争法路径的自然衔接,最终在建设全国统一大市场背景下,实现平台经济生态开放层面的高水平互联互通。The high-quality interconnection of services and data is the basis for the rapid development of the platform economy. In view of various types of platform refusal to interconnect, China mainly adopts the Anti-unfair Competition Law post-conducted regulatory approach and the pre-conducted primary responsibility approach of the super-large platform to remedy refusal to interconnect. However,due to the dynamic and complex platform economy competition, the existing approaches are clearly insufficient. It is necessary to implement the supplementary Anti-Monopoly Law approach with multiple mechanisms and collaborative regulations to fully realize the platform interconnection correspondingly.Specifically, under the background of introducing and expanding competitive neutrality, the Anti-Monopoly Law approach needs to redesign independent essential facility doctrine for the platform economy to reasonably reduce the scope and degree of platform main responsibility. At the same time, build a joint regulatory mechanism of “platform contract + industry autonomy” to achieve the long-term operation of platform interconnection, contract governance mechanism design, and the natural connection between the Anti-Monopoly Law approach and Anti-Unfair Competition Law approach. It is hoped that with the establishment of a national unified large market, China will eventually achieve the high-level interconnection of the platform economy ecological openness.
