摘　　要：人工智能正在颠覆版权利益分配方式,AI提供者与版权人的利益博弈日益激烈,“选择退出”制度成为缓解问题的核心。AI数据挖掘“选择退出”制度引入版权法能够缓解市场失灵、实现技术变革与版权法协调,达到实体与程序公平性。伴随合理使用、默示许可制度在人工智能时代的分配机制失效,法定许可模式与“选择退出”制度能够达到逻辑契合。然而法定许可模式的具体施行仍存在限度难以界定、程序模糊不清以及付酬标准与监管体系等配套措施脱节问题。我国应主动修正,以版权法新增条款为实施核心,以“选择退出”的具体程序为运行保障,配套相应的付酬标准与监管措施协同制度有效运行。Artificial intelligence is subverting the profit-sharing arrangement of the copyright,and the benefit game between AI providers and copyright owners is becoming increasingly fierce.The“opt-out”system has become the core to mitigate the problem.The introduction of“opt-out”system into the copyright law for AI data mining can alleviate the market failure,achieve the coordination between the technological change and copyright law,and realize the fairness in both the entity and the procedure.While the distribution mechanism of the fair use and implied license system in the era of artificial intelligence becomes invalid,the statutory license model and the“opt-out”system can reach an agreement in logic.However,in the specific implementation of the statutory license model,there still exist some problems.For example,it is difficult to define the limit,the procedures are ambiguous,and the supporting measures such as the payment standard and regulatory system are disjointed.China should make the initiative to amend it,take the newly added provision of the copyright law as the core for the implementation,take the specific procedure of“opt-out”as the guarantee for operation,and make the supporting measures such as the payment standard and coordinated regulatory system operate effectively.
