土地经营权抵押融资中抵押权的设立

摘　　要：土地经营权抵押融资制度是盘活农村资产、增加融资的重要举措,但是囿于法律规定的模糊以及理论界和实务界的争议,土地经营权抵押融资制度中抵押权的设立环节仍有一些问题需要明确。应准确界定抵押人和抵押权人的范围;抵押权的客体范围应包括地上的种养物,对于附属设施则应该区别对待;抵押权的设立不以土地经营权的登记为前提;“经承包方书面同意”程序不具备妥适性,违之并不影响抵押权的效力;以其他方式取得的土地经营权抵押融资并无适用或类推适用“经承包方书面同意”程序的空间。土地经营权抵押权的登记亦需要区分具体情况而为,满足登记的可操作性。The mortgage financing system of land management rights is an important measure to revitalize rural assets and increase financing.However,due to the ambiguity of legal provisions and the dispute in both theoretical and practical fields,there are still some issues that need to be clarified regarding the establishment of the mortgage rights in the mortgage financing system of land management rights.The scope of mortgagor and mortgagee should be defined accurately;The scope of the object of the mortgage right should include the plants and livestock on the ground,and the ancillary facilities should be treated differently;The establishment of mortgage right is not based on the registration of land management right;The procedure of"with the written consent of the contractor"is not appropriate,and the violation does not affect the validity;There is no room for the application or analogy of"with the written consent of the contractor"procedure for mortgage financing of land management right obtained by other means.The registration of the mortgage of the land management right also needs to be differentiated according to specific circumstances to meet the operability of registration.
