摘 要:区际碳公平问题的解决有利于保障我国“双碳”目标的实现。以私法的严格责任方式解决区际碳公平问题存在正当性不足、可诉性差等障碍;以救济个体权利为主的用益物权路径对具有公共利益面向的碳公平问题作用有限。要合理、高效地解决碳公平问题,需要考虑国家政策导向的历史原因,充分认识到碳公平的实质是地区发展不平衡,并结合碳公平的现实表现形态。我国促进区际碳公平应当采用公权为主私权为辅的激励性制度,并在进一步优化的基础上确立激励性的核心制度。State can accomplish the dual carbon target while the trouble of inter-regional carbon equity is overcome.There are invalidity and non-litigation in overcoming inter-regional carbon equity by strict responsibility in private law;It is limited to address public interest-oriented carbon equity by building usufructuary right,which focus on remedy for individual benefit.In order to reach the goal efficiently and reasonably,the state should consider its policy guidance in history and the performance of carbon equity and accept that regional development determines carbon equity.This article points out that a core institution should be established to promote the inter-regional carbon equity by stimulating and optimizing the incentive institution which takes public power as a focus and private right as an aid.
