摘  要:全国人大常委会宪法解释权的规范形成是一个跨时代的连续性过程。陕甘宁边区议会及其常委会的宪法解释权,与中央人民政府委员会的《中央人民政府组织法》解释权,为全国人大常委会宪法解释制度的建立积累了经验。“宣传和教育宪法规定的宪法解释”“修改和补充宪法内容的宪法解释”和“评注宪法文本的宪法解释”,这三种制宪者的宪法解释观,奠定了全国人大常委会宪法解释制度的观念基础。从1978年宪法到1982年宪法,历经两次宪法修改,宪法解释权与宪法监督权形成紧密的结合,其性质、功能和行权方式均有别于其他职权,具有较强的内在限制性。The normative formation of the NPC Standing Committee's power to interpret the Constitution is a continuous process across the era.The power to interpret the Constitution of the Shanxi-Gansu-Ningxia Border Regional Assembly and its Standing Committee,as well as the power to interpret the Organic Law of the Central People's Government of the Central People's Government Committee,have accumulated experience for the establishment of the constitutional interpretation system of the NPC Standing Committee.“Publicizing and educating the constitutional interpretation of the provisions of the Constitution”,“constitutional interpretation of amending and supplementing the content of the Constitution”,and“constitutional interpretation of commenting on its text”these three constitutional interpretation concepts of the framers of the constitution have laid the conceptual foundation for the constitutional interpretation system of the NPC Standing Committee.From the 1978 Constitution to the 1982 Constitution,after two constitutional amendments,the power to interpret the Constitution and the power to supervise the Constitution have formed a close combination,and their nature,functions and methods of exercising power are different from other functions and powers and have strong internal restrictions.
