领域法学视野下航空法学的学科定位与培养体系建构

摘　　要：法治现代化建设要求对复杂社会领域实现依法治理,需要具有领域法治思维的法治人才参与。航空法治人才培养,既是对新时代人才培养任务的践行,也是推进航空领域法治化发展的必要支撑。然而,部门法学视野下,航空法学学科定位失准,难以为航空领域法治建设提供必需的知识体系与研究方法,导致航空法治人才缺乏系统性培养。领域法学理论契合航空法学等交叉法学学科的特性,能指引学科内容体系构建,并进一步引导人才培养体系建构。培养航空法治人才,应当确立航空法学的领域法学定位,以航空法学的核心命题为导向,确立航空法学的基本研究范畴,生成航空法学的内容构成、研究方法和价值体系,在此基础上确立共性与个性并重的培养原则、层次化构建航空法学核心课程、模块化编排航空法治专业课程、推动航空法学教学科研结合,构建人才培养体系。The modernization of the rule of law requires the realization of governance according to the law in complex social fields,which necessitates the participation of legal talents with domain-specific thinking.The cultivation of aviation legal talents is not only the implementation of talent cultivation tasks in the new era,but also a necessary support for promoting the rule of law in the aviation field.However,the positioning of aviation legal studies from the perspective of departmental legal studies is inaccurate,making it difficult to provide necessary knowledge system and research methods for legal construction in the aviation field,which results in a lack of systematic cultivation of aviation legal talents.The theoretical framework of domain-specific legal studies aligns with the characteristics of interdisciplinary legal subjects such as aviation legal studies,can guide the construction of the disciplinary content system and then guide the construction of the talent cultivation system.In order to cultivate aviation legal talents,it is necessary to establish the domain-specific positioning of aviation legal studies,orientate it towards the core propositions of aviation legal studies,establish the basic research categories of aviation legal studies,and generate the content structure,research methods and value system of aviation legal studies.Based on this,the cultivation principles of emphasizing both commonality and individuality should be established,and the hierarchical construction of core courses in aviation legal studies as well as modular arrangement of specialized courses on aviation rule of law should be carried out,and the integration of aviation legal studies teaching and research should be promoted to construct a talent cultivation system.
