构建中国特色体育法学话语体系的时代意义与现实路径

摘　　要：构建中国特色体育法学话语体系以推进我国体育法学学科学术体系发展和体育法治建设为背景,是我国体育法学学科、学术建设的必然延伸,也是解读我国体育法治实践的现实需要,还是供给体育法治话语、引领国际体育治理的必然要求。体育法学话语体系是我国参与解决体育治理议题、传递我国观点立场的表达基础。中国特色体育法学话语体系是站在中国立场、立足中国实践,表达体育法学理论的话语系统,其依托中国特色体育法学学科、学术体系的发展而不断完善。在路径选择上,我国体育法学话语体系的构建应以反哺学科、学术体系为直接目标,通过完善体育法理论体系、整合言语表达、转向多元共治,以及推进内外联动的现实路径,积极开展中国特色体育法学话语体系建设,以提升我国国际体育治理的影响力。As the materialization of the strategy of the rule of law in the field of sports,sports gove rnance of law has become the necessary way to promote the"sports power construction strategies"in China.After more than twenty years of development,the academic community has gradually reached a consensus on the basic theory,discipline content and research fields of sports law,and the legislation and practice of sports law have also been improved,and a sports law discipline and academic system with Chinese characteristics is being formed.In response to this,it is necessary to build a sports law discourse system with Chinese characteristics.It is an inevitable extension of the discipline and academic construction of sports law in China,a practical need to interpret the development of sports in the New Era and promote the sports governance of law,and an inevitable requirement to summarize the practice of the rule of law in Chinese sports and lead the change of international sports governance.The construction of sports law discourse system should respond to the needs of the time,with the direct goal of feeding the discipline and academic system,focusing on improving the theoretical system of sports law and comprehensively integrating speech expression;with the realistic goal of striving for discourse power,fully reflecting the diversified governance system,and paying attention to promoting domestic and international linkage.
