摘  要:从1985年国家实施“一五”普法规划以来,宪法宣传教育在当代中国社会中轰轰烈烈开展,并已经取得了诸多良好实绩。立足宪法所具有的政治性和法律性双重属性,宪法宣传教育包涵政治型和法律型两种基本类型。从宣传教育的体制、对象、方法三个方向依次考察,政治型宪法宣传教育的理论架构分别是:坚守“国家主导、自上而下”模式、把握“全体人民”以及宪法文化的时空与仪式建构;从三个相同方向剖析,法律型宪法宣传教育的内在架构呈现为:遵循“社会主导、自下而上”模式、激活“基本权利主体”以及普及基本权利常识。宪法宣传教育实践的政法合奏是宪法整合、国家整合的重要环节。为了持续增进宪法认同,可以从两个方向着力优化:一是补强法律型宪法宣传教育的主导逻辑;二是协调宪法宣传教育的政治性与法律性。Since the national “first five-year plan”for law popularization in 1985, constitutional publicity and education have been vigorously carried out in contemporary Chinese society, and many good achievements have been made. Based on the political and legal natures of the constitution, the publicity and education of the constitution includes two types: political type and legal type. From the perspective of the system, object and method of publicity and education, the theoretical framework of political type includes: adhering to the“state-leading, top-down”model, mastering“all the people”and the systematic construction of constitutional culture;The internal structure of legal type is as follows: following the“society-leading, bottom-up”model, activating the“subject of basic rights”and popularizing the common sense of basic rights. The political and legal ensemble of constitutional publicity and education practice is an essential part of constitutional integration and national integration. In order to continue to enhance constitutional identity, we can focus on optimization in two directions: the first is to strengthen the logic of the political type of constitutional publicity and education;The second is to coordinate the political and legal nature of constitutional publicity and education.
