摘　　要：归因于生产要素的组合创新和经验主义的惯性问题、劳动法逻辑起点的认识不统一、从属性标准的解释乏力和框架缺憾,新业态从业者存在“从属劳动者”“独立劳动者”和“第三类劳动者”三种身份假设,带来新业态从业者的权益保护危机。劳动法坚持以“劳动者为中心”的人权理念决定了新业态从业者的身份认定应选择从属性标准,通过反思从属性的理论基础探究以“拘束”为核心理顺从属性标准的体系构成,类别化新业态用工形态,创新从属性标准的具体适用规则。Today, how to protect the rights and interests of practitioers in new business forms is a hot topic in the field of labor law and practice. And the crux of the problem focus on the legal identity disputes of practitioers in new business forms. Due to the combination innovation of production factors and the inertia of empiricism, the epistemic disunity of the logical starting point of labor law, the weak interpretation and the deficient framework of the subordinate standard, there are some disputes about the legal identity of practitioers in new business forms. In summary, there are three main hypotheses. Firstly, the subordinate worker who conforming to the situation of establishing labor relations. Secondly, the independent worker in a self-employed situation. Lastly, the third category workers who not fully conforming to the situation of establishing labor relations. As a result, these hypotheses bring about the crisis of protect the rights and interests of practitioers in new business forms. The essay concluded that the labor law should adhere to the concept of "labor-centered" human rights, which determines that, firstly, the legal identification of practitioers in new business forms should choose the subordinate standard. Then, we should take the binding force as the core to straighten out the system structure of the subordinate standard by reflecting on the theory of subordination. Finally, we need to innovate the specific rules for the application of the subordinate standard center on the facts.
