摘　　要：晋冀鲁豫边区的刑事调解制度是中国共产党百年奋斗推进法治建设的重要组成部分,是中国式刑事和解现代化的启程阶段。通过数据分析、史料归纳等方法从该制度的形成背景、基本规范、程序运行机制出发,总结出边区刑事调解有效经验:(一)明确调解对象与主体;(二)限定调解范围;(三)确认调解方式与效力。刑事调解制度延续了中国古代民刑不分的惯例,民刑调解程序一体,民事调解范围涵盖所有民事案件,甚至在司法文件中规定“厉行调解”;刑事案件的调解程序运行则在晋冀鲁豫边区下属的冀南区行政公署中有着较为具体的规定,并通过条例确定下来。晋冀鲁豫边区刑事调解制度特色:刑事调解价值设定上贯彻群众路线;刑事调解形式上实现多元主体共治;加强刑事和解参与;完善刑事和解相关机制。The criminal mediation system in the Shanxi-Hebei-Shandong-Henan Border Region is an important component of the rule of law construction advanced by the century-long struggle of the Communist Party of China and marks the initial stage of the modernization of Chinese-style criminal reconciliation.Through data analysis,historical materials induction,and other methods,this paper starts from the background,basic norms,and procedural operation mechanism of the formation of this system to summarize the effective experience of criminal mediation in the border region:(1)Specifying the objects and subjects of mediation;(2)Limiting the scope of mediation;(3)Confirming the methods and efficacy of mediation.The criminal mediation system in the region continues the ancient Chinese practice of not distinguishing between civil and criminal matters and integrating civil and criminal mediation procedures.The scope of civil mediation encompasses all civil cases,with judicial documents even mandating“vigorously implementing mediation”.The operation of criminal case mediation procedures has more specific provisions within the Hebei Southern Area Administrative Office under the Shanxi-Hebei-Shandong-Henan Border Region and is established through regulations.Moreover,the characteristics of the criminal mediation system in the region are as follow:The value of criminal mediation is set in accordance with the mass line;the form of criminal mediation achieves co-governance by multiple subjects.It’s recommended to strengthen participation in criminal reconciliation and improve mechanisms related to criminal reconciliation.
