包拯监察思想及其当代启示

摘　　要：包拯的监察思想在家庭熏陶、时代背景和儒、道、佛三教思想共同影响下形成,深受儒家仁、义、礼、智、信等核心价值观念影响。其监察思想的主要内容包括:(一)监察主体:应防微杜渐、禁恶于未然,直陈时弊、敢于进谏,谏言真实、公正无私,关心百姓;(二)监察对象:违法犯纪、庸官懒政;(三)监察目的:安民,保民,惠民;(四)监察职责:德才兼备、职位与能力相称,严格控制私欲、保持清廉公正;(五)监察程序:简化告状程序、利国便民,注重实地考察、谨慎评估。包拯监察思想对当代的启示:重视监察官员选任资格,规范监察尺度和人权保障,建立健全监察问责机制,全面提升监察人员素质。Bao Zheng’s philosophy of supervision was cultivated by his family environment,the era background,and the intertwined teachings of Confucianism,Taoism,and Buddhism.It was particularly shaped by the core Confucian values of benevolence,righteousness,propriety,wisdom,and faithfulness.The main components of his philosophy of supervision include:(1)For supervisory subjects:they should prevent minor issues from becoming serious,prohibit wrongdoing before it occurs,speak out against the ills of the time,dare to offer candid advice,ensure that their counsel is truthful and impartial,and care for the welfare of the people;(2)For supervisory objects,they are those who break the law and discipline,and those who are incompetent or slack in office;(3)Supervisory objectives:to stabilize,protect,and benefit people;(4)Supervisory qualifications:to possess morality and talent,to hold capability well-matched to his or her position,to exercise restraint over personal desire,and to uphold integrity and injustice;(5)Supervisory procedures:to simplify the process for lodging complaints to benefit the nation and its people;to emphasis on field research and prudent assessments.The contemporary enlightenment of his philosophy of supervision includes:valuing the qualifications of supervisory officials,standardizing supervisory measures and human rights protection,establishing a sound supervisory accountability mechanism,and comprehensively enhancing the quality of supervisory personnel.
