摘 要:随着国家法治建设的不断推进,高校自治已然成为一项时代课题。高校治理最典型的体现是以大学章程为代表的高校规范性文件体系。当前高校规范性文件审查呈现从形式向实质转变的趋势,与此同时,在理论上存在审查理念消极、守旧的难点,在实务中存在审查主体难以选择、审查方式难以契合、审查内容难以落实、审查标准难以掌握的堵点。针对当前高校规范性文件审查机制建设进程中面临的理论难点、实务堵点,应当建立以争议当事人为基础的选择性审查机制,授予争议当事人自主申请关联机关审查的权利,激活和激励审查相关配套机制的功能运转,以此发挥审查机制作用。With the continuous advancement of the country's rule of law,university autonomy has become an issue of our time.The most typical manifestation of university governance is the system of normative document represented by university charter.There is a trend in the current review of normative documents in universities,shifting from formal review to substantive review.At the same time,there are difficulties in terms of negative and conservative reviewing concepts in theory,as well as challenges regarding the selection of reviewing subjects,alignment with reviewing methods,implementation of reviewing content,and mastery of reviewing standards.Aiming at the issues,it is necessary to establish a selective review mechanism based on the disputing parties,which grants them the right to independently apply for review by the related authorities,thereby activating and incentivizing the operation of relevant supporting mechanisms and fulfilling the role of the review mechanism.
