论环境司法的理性

摘　　要：司法必须具备理性。环境司法的理性主要包括“政策理性”“法律理性”“智慧理性”。环境司法的基本精神必须符合党和国家的大政方针,即需要具有高度的政策理性,体现出司法的政策特质;司法的法律性要求环境司法的实践必须严格遵循法律法规的规定,即具有严谨的法律理性;司法的个案性注重事实的差异性以及因果关系的复杂性与可识别性,在个案事实中追求公平正义,须践行公正的智慧理性。就其内在关系而言,法理与政理涵养环境司法的“灵魂”,政理与智理强健环境司法的“骨骼”,智理与法理训练环境司法的“技艺”。应综合认知和把握环境司法理性的有机融合与辩证统一,克服单一视角下对环境司法理性认知的局限与偏差。基于实践所需,我国的环境司法需进一步妥善处理司法能动的“政策理性”、衡平环境司法效能的“法律理性”、辩证规范环境司法的“智慧理性”。Justice must be rational.The rationality of environmental justice mainly includes"policy rationality","legal rationality"and"wisdom rationality".The basic spirit of environmental justice must be in line with the Party and the country's major policy,that is,it needs to have a high degree of policy rationality and reflect thepolicy characteristics of justice.Judicature requires that the practice of environmental judicature must be strictly in accordance with the provisions of laws and regulations,that is,with strict legal rationality;the case-nature of justice pays attention to the difference of facts and how complex and identifiable the causality is.In the pursuit of fairness and justice in the case facts,it is necessary to practice the just wisdom and rationality.In terms of their inherent relationship,legal and political rationalities nurture the"soul"of environmental justice,political and intellectual rationalities strengthen the"skeleton"of environmental justice,and intellectual and legal rationalities train the"skills"of environmental justice.It is supposed to comprehensively understand and grasp the organic integration and dialectical unity of environmental judicial rationality,and overcome the limitations and biases of environmental judicial rationality from a single perspective.Based on the need in practice,environmental justice in our country needs to further properly handle the"policy rationality"of judicial agency,balancing the"legal rationality"of environmental judicial effectiveness,and dialectically regulating the"wisdom rationality"of environmental justice.
