地理标志与地名商标的冲突体现与解决方式

摘　　要：[目的]分析我国地理标志与地名商标冲突的表现及原因,提出地理标志与地名商标冲突问题的解决方式。[方法]主要采用文献研究法和比较研究法,通过对冲突现状及国外解决冲突的对策进行分析,提出适宜我国解决冲突的建议。[结果]我国地理标志与地名商标冲突的主要原因包括法律历史遗留、地理标志保护力度较弱及现行保护模式存在缺陷等3个方面。[结论]可以借鉴法国,建立以专门法保护为主的地理标志保护模式,并对解决冲突的法律规范从“时间在先,权利在先”、侵权认定和有限共存等3个角度作出相应的细化处理。s:[Purposes]This paper analyzes the manifestation and reasons of the conflict between geo-graphical indications and geographical name trademarks in China to put forward the solution to the prob-lem of conflicts between geographical indications and geographical name trademarks.[Methods]This pa-per mainly adopts the literature research method and comparative research method,analyzing the current situation of the conflict and foreign countermeasures to solve the conflict,and proposing suitable counter-measures to solve the conflict in China.[Findings]The main reasons for the conflict between geographi-cal indications and geographical name trademarks in China are the historical legacy of the law,the weak protection of geographical indications and the defects of the current protection mode.[Conclusions]It is recommended to refer to France to establish the protection mode of geographical indications which is mainly based on the protection of special law,and make corresponding refinement to the legal norms for resolving the conflict from the perspectives of"time first,right first",infringement determination,and limited coexistence.
