村民自治组织与农村集体经济组织的关系新探——基于发展新型农村集体经济的思考

摘　　要：村民自治组织和农村集体经济组织的交织关系,表现为理论和实践中对集体所有权行使主体的认知困惑。农民集体是村民自治和集体所有权的主体,村民自治组织和农村集体经济组织都是农民集体的执行机构,只是承担的职能不同。基于集体所有权主体分置的产权结构,立法通过确立主体代表化的权利行使机制,将农村集体经济组织确立为集体所有权的当然行使主体,纾解了集体所有权的主体虚化之困。在未设立农村集体经济组织的地区,村民委员会、村民小组依法代表农民集体行使集体所有权,参照适用农村集体经济组织的决议规则,讨论并决定集体财产的经营、管理和收益分配。在村组分级的代行关系下,村民小组可以将代行职能上交村民委员会,但不得改变既有的集体所有权关系。The intertwined relationship between villagers'self-governing organizations and rural collective economic organizations result in the cognitive confusion about the subject of the exercise of collective ownership in theory and practice.The farmers'collective body is the subject with villager autonomy and collective ownership,and both villagers'self-governing organizations and rural collective economic organizations are the executive bodies of the farmers with different functions.Based on the structure of property rights in which the subjects of collective ownership are divided,the legislation establishes the rural collective economic organization as the ex officio subject of collective ownership through the right exercise mechanism of the representative subject,thus alleviating the problem of the virtualization of the subjects of collective ownership.In areas where rural collective economic organizations have not been established,villagers'committees and villagers'groups exercise collective ownership on behalf of the farmers in accordance with the law,discussing and deciding on the operation,management,and distribution of proceeds of the collective property with reference to the resolution rules of the rural collective economic organizations.Under the representative relationship with the classification of village-level and group-level,villagers'groups may hand over their representative functions to villagers'committees,but may not change the established relationship of collective ownership.
