人脸识别的侦查价值及其风险控制研究

摘　　要：风险社会中技术的迭代会产生技术应用的风险,人脸识别技术是人工智能发展的具体应用,在打击犯罪侦破案件过程中人脸识别技术得到了广泛应用。公安机关应用人脸识别技术的目的在于提高侦查效率,从而有效地掌握案情,打击犯罪。运用好人脸识别技术为侦查活动服务,这是其侦查价值之所在。技术是把双刃剑,在带来便利的同时,人脸识别技术的应用也会导致法律定位模糊、所获取的证据归属不明、易侵犯个人信息、算法歧视等多重风险隐患。面对人脸识别技术的应用风险,要从风险控制方面入手,使人脸识别技术更好地服务于侦查工作。应对人脸识别技术所产生的风险要从程序控制上明确其法律定位,完善证据规则,强化个人信息保护,优化算法水平,从而对人脸识别技术在应用中所带来的风险进行有效地控制。The iteration of technology in the risk society will generate the risk of technology application.Face recognition technology is the specific application of the development of artificial intelligence,and has been widely used in the process of combating crime and solving cases.The purpose of the application of face recognition technology in public security organs is to improve the efficiency of investigation,so as to effectively grasp the case,fight crime,and use face recognition technology to serve the investigation activities,which is the value of its investigation.Technology is a double-edged sword.With bringing convenience,the application of face recognition technology will also lead to multiple risks such as blurred legal positioning,unclear ownership of the obtained evidence,easy infringement of personal information,and algorithm discrimination.Facing the application risk of face recognition technology,it is needed to start from the aspect of risk control,so that it can better serve the investigation work.In response to the risks generated by face recognition technology,it is required to clear its legal positioning from the program control,improve the rules of evidence,strengthen the protection of personal information,and optimize the level of algorithms,so as to effectively control the risks brought by face recognition technology in the application.
