摘 要:根据我国《民法典》,担保物权的实现方式包括拍卖、折价、变卖三种。担保物权的变卖、折价参照市场价格。但法律法规没有为市场价格的形成提供扎实的理论和方法。担保物权实现时新增财产的评估,市场价格评估时间的选择不甚规范,担保物权的公平实现存在很大任意性。资产评估技术在国内外发展已经相当成熟,其中协同价值、基准日等理论和实践经验可以为担保物权实现的价格形成提供完善的解释方案。在民商法适当引入现代资产评估技术,可以更好地认定合理的担保物权实现价格,以更加理性的量化实现民法追求的公平,以现代资产评估技术助力中国式法治现代化。According to our Civil Code,there are three ways to realize security interest:auction,converted into money or sold off.The sale and converted into money of the security interest shall refer to the market price.However,laws and regulations do not provide a solid theory and method for the formation of market prices.The valuation of new property when the security interest is realized and the selection of the market price valuation date is not standardized,the fair realization of the security interest is very arbitrary.In economic law,valuation technology has been developed quite maturely at home and abroad,and theoretical and practical experiences such as synergistic value and valuation date can provide a perfect explanation scheme for the price formation of security interest.The appropriate introduction of modern valuation technology in civil and commercial law can better determine the reasonable realization price of security interest,realize the fairness pursued by civil law with more rational quantification,and modernize the rule of law with modern valuation technology.
