摘　　要：文章主要叙述了石油化工行业工程建设过程中采购施工总承包固定总价合同模式,以及该模式下在招投标阶段作为招标人以及投标人在招标及投标过程中应该注意的问题,明确双方要树立利益共同体的总体观念。在招标/投标文件编制、招标资料提供、投标答疑及澄清、合同谈判和签订的整个过程中一定要有大局观,明白清楚地表达各自的需求和察觉到的风险,事前控制、公平公正分担各项风险、减少争议,最终确保项目目标的顺利实现。This paper mainly describes the fixed total price contract mode of procurement construction in the construction process of petrochemical industry,as well as the tenderer and bidders in the bidding and bidding process,and makes clear the overall concept that both sides should establish a community of interests.In the tender/bidding documents,bidding materials,bidding questions and clarification,contract negotiation and sign the whole process must have a big picture,clear express their needs and perceived risk,prior control,fair share the risk,reduce disputes,finally ensure the smooth realization of the project goal.
