摘　　要：知识产权是新质生产力中的关键要素,在经济层面,知识产权的创新转化构成新质生产力形成的重要驱动;在法律层面,知识产权的妥善治理为新质生产力发展保驾护航。相较于传统生产力,新质生产力包含全新质态要素,依托于颠覆性技术创新,其蓬勃发展呼唤知识产权治理的现代化。构建与新质生产力相适应的知识产权治理体系,需要在治理理念上衡平知识产权保护和利用、促进法律与技术深度融合、兼顾激励创新与权益保护,在制度建设上注重基础性法律的制定和强化新业态、新领域的规范指引,同时回应新质生产力的高科技、高效能和高质量特征要求,促进运行机制的专业化、快捷化和协同化。Intellectual property is a key element in new quality productive forces.In the demesne of economy,intellectual property is an important driving force for the formation of new quality productive forces.In the legal stratification plane,the proper governance of intellectual property safeguards the development of new quality productive forces.Compared to traditional productivity,new quality productive forces contains new qualitative elements,relies on disruptive technological innovation,and their vigorous development calls for the modernization of intellectual property governance.To construct intellectual property governance system compatible with new quality productive forces,we should renovate governance concepts by balancing the protection and utilization of intellectual property,promoting the deep integration of law and technology,and coordinating stimulation innovation and rights protection.In terms of institutional construction,we should promote the formulation of basic laws and strengthen the regulatory guidelines in new formats and fields.Simultaneously,responding to the high-tech,high-efficiency and high-quality characteristics of new quality productive forces,we should stimulate the specialization,efficient and coordination of operating mechanism.
