摘 要:我国各地法院依据现行法律规定实施的“强制管理”,实质上是一种结合强制管理制度特点与不动产财产特征进行变通的折价抵偿方式。由于管理人制度这一核心内容缺失,这样的探索实践难以有效发挥其促进物尽其用、实现各方当事人合法利益的预期效用,更无法达到完善民事执行措施体系的远景目标。在对强制管理人探索实践进行模式考察,并总结其实践经验与不足的基础上,管理人制度应构建在以执行辅助人为身份定位、遵循独立性与有限性行为基本准则的理论基础之上,并从管理人的选任与辞任、具体职责配置、配套机制与监督评价体系等层面,形成更具系统性的制度供给。The"mandatory management"implemented by the courts around China according to the existing legal provisions is more like a kind of discounted compensation combining the characteristics of the mandatory management system and the characteristics of real estate property.Due to the absence of the core content of the manager system,such an exploration practice is difficult to effectively play its expected utility to promote the best use of things,realize the legitimate interests of all parties,and even more unable to achieve the vision of perfecting the system of civil enforcement measures.On the basis of examining the mode of exploring the practice of mandatory manager and summarizing its practical experience and shortcomings,the manager system should be constructed on the theoretical basis of positioning the identity of the execution auxiliary person,following the basic norms of independence and limited behavior,and providing a more systematic system supply in terms of the selection and resignation of the manager,the configuration of the specific duties,the supporting mechanism and the supervision and evaluation system.
