非法占用农用地罪的司法认定中“未经处理”的二元构造

摘　　要：在非法占用农用地的案件中,对“未经处理”的理解直接关涉定罪与量刑。争议的实质系“未经处理”的解释是否能够包含“未经行政处理”。应澄清的是,多次累计犯中的多次行为包含了无关联的多次行为,并且“未经行政处理”的审查对象仅限于“无关联多次行为中的行政违法行为”,因而司法解释选择将不同犯罪中的“未经处理”解释为“未经刑事处理”或“未经行政与刑事处理”只是基于刑事政策的需求。在非法占用农用地罪的司法解释中,对于“依法应当追诉”或“依法应当追究刑事责任”的累计计算情形,“未经处理”的审查对象系“多个单次均能达到追诉标准的行为”或“多次行为能被评价为一个行为单数”,因而其只能被解释为“未经刑事处理”。基于对耕地的特殊保护而产生的“一年内多次实施本解释规定的行为未经处理”的规则设计,“未经处理”应包含“未经行政处理”,以限缩司法解释越位续造扩大的处罚范围。In many cases of illegal occupation of agricultural land,the understanding of"untreated"is directly related to conviction and sentencing.The essence of the dispute is whether the interpretation of"untreated"can include"untreated by administrative law".It should be clarified that multiple acts in multiple cumulative crimes include unrelated multiple acts,and the object of review of"untreated by administrative law"is limited to"administrative illegal acts in unrelated multiple acts."Therefore,the judicial interpretation chooses to interpret"untreated"as"untreated bycriminallaw"or"untreated by administrative and criminal law"in different crimes only based on the needs of criminal policy.In the judicial interpretation of the crime of illegally occupying agricultural land,the cumulative calculation of"prosecution should be pursued according to law"or"criminal responsibility should be investigated according to law",the"untreated"examination object is"each of the multiple acts meets the prosecution standard"or"multiple acts can be evaluated as a singular act",so it can only be interpreted as"untreated by criminal law".Based on the special protection of cultivated land,the rule design of"the act of repeatedly implementing the provisions of this interpretation in one year without treatment"should include"untreated by administrative"to limit the expanded scope of punishment for the offside continuation of judicial interpretation.
