摘　　要：当前人工智能等数字技术蓬勃发展,司法领域以数字改革赋能助力法院、检察院工作现代化,由此掀起人工智能司法变革的时代浪潮。通过融合人工智能等数字技术,正逐步构建高效、透明、便民的智慧司法体系,实现管理优化与服务升级,也为公众提供了更为便捷、高效的法律服务体验。然而,人工智能司法变革过程中仍存在伦理与技术的双重风险:在伦理层面,司法工作人员的主体性地位受到威胁;在技术层面,由于智能算法本身的技术缺陷,司法实务中易出现数据泄漏、内容失真等问题。文章认为,针对伦理层面的风险,司法改革应当强调司法工作者的主体性地位,将人工智能技术定位为司法辅助工具;针对技术层面的风险,应当及时优化算法机制,保障司法数据的真实性与准确性,从而推动我国人工智能司法变革,全面深化智慧法院建设,创造更高水平的数字正义,推动智慧法治建设迈向更高层次。With the booming development of digital technologies such as artificial intelligence,the judicial field is empowered by digital reform to help modernize the work of courts and procuratorates,thus triggering a wave of AI judicial reform.By integrating digital technologies such as artificial intelligence,we are gradually building an efficient,transparent,and convenient smart judicial system,achieving management optimization and service upgrades,and providing the public with a more convenient and efficient legal service experience.However,there are still dual ethical and technological risks in the process of artificial intelligence judicial reform:at the ethical level,the subjectivity of judicial personnel is threatened;at the technical level,due to the inherent technical defects of intelligent algorithms,problems such as data leakage and content distortion are prone to occur in judicial practice.The article believes that in response to ethical risks,judicial reform should emphasize the subjectivity of judicial workers and position artificial intelligence technology as a judicial auxiliary tool;for technical risks,we should timely optimize the algorithm mechanism to ensure the authenticity and accuracy of judicial data,so as to promote China's AI judicial reform,comprehensively deepen the construction of smart courts,create a higher level of digital justice,and promote the construction of smart rule of law to a higher level.
