摘　　要：行政机关单方变更行政协议,是行政协议“行政性”优于“协议性”的体现,是公益优先原则对合同严守原则的“突破”。加之实践中行政机关不说明理由、说理不即时或说明理由不恰当不充分,降低了变更协议决定的可接受度,增加了协议履行成本,造成了人民法院监督内容不完整。行政机关应当积极主动地阐明变更协议的事理、法理、情理和文理,明确变更原因与理由不同地位和功能。行政机关应结合实际将不确定的协议变更原因一一转换为与之匹配的确定的具体的变更决定,发挥说明理由沟通行政机关、协议相对人和人民法院三方,链接立法、执法和司法的作用。由此缓解单方变更行为对于行政协议“协议性”的冲击,弥合公益优先与合同严守之间“裂痕”。The unilateral change of the administrative agreement by the administrative organ is the embodiment of the“administrative”superior to the“agreement”of the administrative agreement,and is the“breakthrough”of the principle of public interest priority to the principle of strict compliance with the contract.In addition,in practice,the administrative organs do not explain the reasons,the reasoning is not immediate or the reasons are not appropriate and inadequate.It reduces the acceptability of the decision to change the agreement,increases the cost of implementing the agreement,and causes the incomplete supervision content of the people s court.The administrative organ should actively clarify the reason,jurisprudence,reason and reason of the change agreement,and clarify the different status and functions of the reasons and reasons for the change.In combination with the actual situation,the uncertain reasons for the change of the agreement are converted into a specific change decision that matches it,and the reasons are communicated to the administrative organs,the counterpart of the agreement and the people s court,linking the role of legislation,law enforcement and justice.In this way,we can alleviate the impact of unilateral change on the“agreement”of administrative agreements and bridge the“rift”between public welfare priority and strict contract observance.
