摘 要:从法律程序层面保障和维护公务员的救济权利,为公务员实现和维护其权利提供法律依据,可以促进国家机关的稳定与有效运作。从实践看,目前我国法律层面关于公务员救济程序的规定较为笼统,受理及审理机关欠缺专职性和相对独立性,审理程序不具公开性,且缺乏质证听证程序,有必要从法律制度上予以完善。完善公务员内部救济程序,应以公务员内部救济程序的性质界定为依托,借鉴国外有益经验,结合我国国情,细化法律层面的救济程序,建立专门的审理机构,公开救济程序,增加有限的听证程序,确保公务员救济程序的公正性。Protecting and safeguarding the relief rights of civil servants from the perspective of legal procedures,and providing legal basis for civil servants to realize and safeguard their rights,can promote the stability and effective operation of state organs.From a practical perspective,the current legal provisions in China regarding the relief procedures for civil servants are relatively vague,the acceptance and trial organs lack professionalism and relative independence,the trial procedures are not open,and there is a lack of cross examination and hearing procedures.It is necessary to improve the legal system.To improve the internal relief procedures for civil servants,we should rely on the definition of the nature of the internal relief procedures for civil servants,draw on useful foreign experience,combine with China's national conditions,refine the relief procedures at the legal level,establish specialized trial institutions,publicly disclose the relief procedures,increase limited hearing procedures,and ensure the fairness of the relief procedures for civil servants.
