我国民航应急动员法律保障建设的路径思考

摘　　要：民航应急动员是国家应急管理体系的重要组成部分。加强民航应急动员建设是完善新时代国家应急管理体系和民航安全管理体系的重要抓手,其中,法律保障建设是关键内容。民航应急动员具有动员主体多元、动员任务多变、动员环境复杂的特征,因专门规则缺位、宣传教育手段单一、法治监督力量缺乏等导致动员主体权责不明、动员行动效率不高和效果不佳。从制定专门规则、加强宣传教育和强化法治监督等方面提出路径建议,保障民航应急动员“规范”“有效”“有力”。Civil aviation emergency mobilization occupies an important position in the national emergency management system.Strengthening the construction of civil aviation emergency mobilization represents a crucial approach to refining both the national emergency management system and the civil aviation safety management system in the new era,and the construction of legal protection occupies a pivotal position in particular.The subject of civil aviation emergency mobilization is characterized by a high degree of diversity with a multitude of actors involved in the process,a vast array of tasks to be completed and complex mobilization environment.The absence of specific regulations,single means of publicity and education,and inadequate legal oversight,have resulted in ambiguity regarding the rights and responsibilities of mobilization subjects,and have consequently undermined the efficiency and effectiveness.Therefore,it is imperative to propose a series of recommendations pertaining to the formulation of specific rules,the reinforcement of publicity and education,and the improvement of legal oversight,with the aim of ensuring the“standardization”,“effectiveness”and“power”of civil aviation emergency mobilization.
