社群精英治理的“分层嵌入-渐进调适”机制分析

摘　　要：“迁徙中国”背景下,学界对进城农民聚居形成的乡缘型城市社区治理共同体建构关注不足。通过建构“分层嵌入-渐进调适”分析框架,以案例研究方法对J社区展开分析发现:发挥乡缘型社群精英作为“关键少数”的中介联结作用,推动法治规范与社会情理的调适整合,是中国特色乡缘型城市社区治理的重要内容。一方面,基层政府对社群精英进行权力行使主体确认、权力行使动力供给与权力行使能力培训,实现社群精英治理参与的制度化嵌入;另一方面,社群精英以乡音为身份标识与进城农民搭建社会关联网络,并立足于自身的社会威望,依据风俗习惯与制度规则和进城农民进行互动,实现了治理参与的社会性嵌入。在此基础上,社群精英灵活采取信息试探、情理疏导、法理规劝、决策协商四种渐进性策略开展行动,形塑了国家与社会、法治与情理的调适过程,确保了乡缘型城市社区治理共同体建设的有效性。Under the background of"China migration",insufficient attention has been paid to the construction of urban homeplace-based communities governance in the academic circle.By constructing an analytical framework of"hierarchical embedding-gradual adjustment",we found that giving full play to the intermediary linkage role of rural urban community elite as the"key minority",promoting the adjustment and integration of the rule of law norms and social reasoning is an important content of the urban homeplace-based communities governance with Chinese characteristics.On the one hand,the community elite realizes the institutional embedding of governance participation under the confirmation of the power exercise subject,power supply and ability training of the grass-roots government.On the other hand,they build a social connection network with migrant farmers by using the local dialect as identity markers,and interact with migrant farmers based on their own social prestige according to customs and institutional rules,realizing the social embedding of governance participation.On this basis,they flexibly adopt four progressive strategies of information probing,reasoning guidance,legal advice and decision consultation to carry out community governance activities,shaping the adjustment process of the rule of law norms and social reasoning.
