摘 要:基本医疗服务本质上是私人产品。健康权入法使基本医疗服务转化为拟制公共产品,而非公共产品或准公共产品。基本医疗服务区别于非基本医疗服务是基本医疗服务成为拟制公共产品的前提,健康从个人事务上升为国家法律义务是基本医疗服务成为拟制公共产品的主要依据,分级诊疗是国家履行被拟制为公共产品的基本医疗服务义务的具体表现。美、英、俄、德等典型国家的立法实践为我国对作为拟制公共产品的基本医疗服务实行全民医保基础上的政府供给提供了可借鉴经验。Basic medical services are essentially private products.The right to health having been enshrined in law transforms basic medical services to fictional public products,rather than public products or quasi-public products.The difference between basic medical services and non-basic medical services is the prerequisite for basic medical services to become fictional public products.Health’s developing from a personal matter into the government’s legal obligation provides primary legal ground for basic medical services to become fictional public products.Hierarchical medical system is the government’s practice to fulfill its obligation of providing basic medical services which have become fictional public products.The legislative experience of typical countries such as the United States,Britain,Russia and Germany provides a reference for the government supply of basic medical services as fictional public products on the basis of universal medical insurance.
